General Terms and Conditions

1. Object
The following General Terms and Conditions represent the exclusively valid conditions of the contractual relationship between shizuku GmbH as operator of the website www.shizuku.ch and the customer of products offered thereupon (hereinafter called „customer“). Deviations from these conditions and possible side agreements are binding for shizuku GmbH only if agreed upon with the customer in writing.

2. Purchase Order
The purchase order, including the order for the dispatch of the ordered goods, is considered valid, and the purchase order as accepted as soon as the customer has accepted the present General Terms and Conditions and has initiated the order.

3. No sale to minors
shizuku GmbH does not sell to minors – in particular no alcoholic beverages. By placing a purchase order on www.shizuku.ch you confirm your age of consent. With respect thereto, it is required that the date of birth is furnished.

4. Methods of payment
All prices are calculated in Swiss Francs (CHF) and include value-added tax. The same applies to the forwarding costs specified. shizuku GmbH reserves the right to adjust prices and conduct sales campaigns of limited duration. Such modifications in prices or sales campaigns of limited duration do not have any effect on goods already ordered. The payment of the goods ordered by the customer is effected either via bank payment (payable in full within 30 days after date of order), via Twint or else via a particular chosen credit card. In particular cases, shizuku GmbH reserves the right to request settlement by means of prepayment. No minimum order value is required.

5. Credit assessment
shizuku GmbH reserves the right to ask for an assessment of financial standing and may, to this end, forward customer details to Intrum Justitia AG. shizuku GmbH may, without further justification, exclude particular menas of payment, in general or with respect to individual customers.

6. Dept collection
After expiration of the payment deadline, the client automatically is in default of payment. shizuku GmbH is entitled to claim dunning costs in the amount of up to CHF 30.00 per request of payment. For the purpose of dept collection, the recovery of the outstanding invoiced value as well as possible dunning costs and interest may be handed over or assigned to Intrum Justitia AG. Moreover the client is liable to reimburse all costs having occured to shizuku GmbH or Intrum Justitia AG in consequence of the default of payment.

7. Delivery
The sales area comprises all of Switzerland and the Principality of Liechtenstein. The goods ordered are delivered to the delivery address furnished by the customer in the purchase order. Delivery is made by SWISS POST within 3-5 working days (Monday to Friday). shizuku GmbH assumes no liability for secondary damage due to delay in delivery. Up to a figure of CHF 350.00, the packaging and forwarding charges amount to CHF 12.00 all inclusive. Free delivery and handling for orders above CHF 350.00 in Switzerland and the Principality of Liechtenstein. When ordering with the option ‘pickup at shizuku Store’, packaging and forwarding charges are waived entirely.

8. Warranty
The order on www.shizuku.ch is binding. As a matter of principle, goods ordered cannot be either returned or exchanged. shizuku GmbH undertakes to offer high-quality products, complying with all regulations of Swiss law and to issue solely accurate data concerning the goods up for sale. In case of delivery of wrong or damaged goods, the customer must inform shizuku GmbH of the deficiency within 5 working days (Monday to Friday) as of delivery, via e-mail ([email protected]) or by regular mail. If this notice is made timely, the goods in question are taken back at the expense of shizuku GmbH and delivered to the customer anew – accurately and as swiftly as possible. Should the goods ordered originally no longer be available, the purchasing price and forwarding expenses are reimbursed to the customer.

9. Customer’s Obligations
The customer warrants that he is authorised to enter into a contract according to applicable law, in particular, that he is of legal age (18 years old). It is incumbent upon the customer to furnish the accurate delivery address. Potential expenses caused by misstatements in filling in a wrong delivery- or billing address have to be borne by the customer. The latter is urged to examine the delivered goods within 5 working days (Monday to Friday). Damaged/inaccurate delivery items must be placed at the disposal of shizuku GmbH for restitution.

10. Disclaimer
Liability on the part of shizuku GmbH and her ancillary staff, exceeding the liability mentioned under cipher 6 (warranty) regarding direct and indirect losses, flaws or other detriments, potentially arising for the customer out of the assertion of the purchase order, or the purchase of the goods, respectively, shall be excluded – as far as permitted by law.

11. Data Security
Personal customer data are treated confidentially, according to the Data Privacy Act. All personal data (in particular data regarding payments and credit cards) are transmitted cryptographically secured.

The website www.shizuku.ch uses Google Analytics, a web analysis service of Google Inc. (`Google`). Google Analytics uses so-called cookies, i.e. text data stored on your computer that analyse your use of the website. The generated information regarding your use of the website (including your IP-address) is generally transferred to Google servers in the USA, where it is stored. Google uses this information to evaluate your use of our website, to compile reports on website activity for website operators and to offer other services relating to website activity and internet usage. If required by law or insofar as third parties have benn commissioned by Google to process this data, it may be passed on to third parties. On no account will Google link your IP address to other data retrieved by Google. Although you can adjust your browser software to prevent the installation of cookies, you might not be able to make full use of all the functions on this website. In making use of our website, you declare your consent in regard to the processing of data obtained about you by Google and used in the aforementioned manner and for the aforementioned purpose

12. Legal Force
The present General Terms and conditions may be modified at any time and without advance notice.

13. Choice of Law and Jurisdiction
The present legal relationship is subject to Swiss law. Jurisdiction for any and all disputes arising from said legal relationship shall rest with the competent court for such matters in the city where shizuku GmbH has her registered office.

14. Severability Clause
Should individual clauses of this contract, including these regulations, be partly or integrally void, or should the contract feature unforeseen loopholes, the validity of the remainder of the stipulations – or parts thereof – remain unaffected. The void or wanting regulations are superseded by the respective lawful regulations.
